Air Pollution Control Commission Notice of Rulemaking

  1. Air Pollution Control Commission Rulemaking

    In accordance with Massachusetts General Laws, Chapter 40A, Section 11, notice is hereby given that the Air Pollution Control Commission is proposing regulations pursuant to the Building Emissions Reduction and Disclosure Ordinance, Boston City Code, Ordinances, Section 7-2.2. The Boston Air Pollution Control Commission is proposing regulations to establish Building Portfolios and Individual Compliance Schedules under the Building Emissions Reduction and Disclosure Ordinance (BERDO). The proposed regulations are available for review on the BERDO webpage at boston.gov/berdo-regulations.

    The City is also inviting informal feedback on Hardship Compliance Plans and the Equitable Emissions Investment Fund. The preliminary proposals are also available on the BERDO webpage at boston.gov/berdo-regulations.  

    If you would like to provide comments you may submit written comments online via this Google form or send written comments to apcc@boston.gov or the Air Pollution Control Commission, Boston City Hall, Environment Department, Room 709, 1 City Hall Square, Boston, MA 02201. Written comments will be accepted for the next twenty-eight (28) days until 12 p.m. on Friday, September 15, 2023. 

    The public will have further opportunity to provide comments during an upcoming hearing. The Commission provides public notice at least ten (10) days in advance of hearings at boston.gov/public-notices. Translation and sign language interpreters are available upon prior request. Requests for accommodation must be made at least five (5) days prior to the hearing, at the address below or by email at apcc@boston.gov
